Lt. Col. Terry Lakin, MD is to face a court martial for his refusal to obey deployment orders, pending proof that it is a lawful order, issued by a commander in chief who meets the constitutional requirements of office. Dr. Lakin explained his refusal in an article published April 8th on American Thinker. The American Patriot Foundation writes:

Army doctor Lt. Col. Terrence Lakin yesterday met with his brigade commander, Col. Gordon R. Roberts, who proceeded to read LTC Lakin his Miranda rights, and who informed LTC Lakin he had the "right to remain silent" because LTC Lakin is about to be charged with serious crimes. Col. Roberts was at age 19 awarded the Congressional Medal of Honor, the only recipient of the nation's highest honor currently on active duty in the Army.

LTC Lakin had previously been ordered in writing to report yesterday to Ft. Campbell, KY and then on to deploy for his second tour of duty in Afghanistan. Lakin refused to obey these orders and instead came to work yesterday morning at the Pentagon. Late yesterday afternoon he was confronted by his brigade commander.

Before the meeting was over, LTC Lakin's Pentagon Access Pass had been revoked, and his laptop computer was set to be confiscated.

The message to LTC Lakin is clear; through official channels, he was informed yesterday that he will shortly be court-martialled for crimes (specifically, missing movement and conduct unbecoming an officer) that for others has led to lengthy imprisonment at hard labor.

Lakin has announced in a YouTube video that has now been viewed more than 110,000 times that he considers it his duty to refuse to obey orders that would be illegal if President Obama is ineligible to hold office.

Meanwhile, cries mount for proof of that eligibility, but nothing has been forthcoming. The Obama campaign at one point released a copy of computer-generated abstract of information purportedly in Hawaii's records system, but the source of this information is unclear and need not have been a birth certificate issued contemporaneously and signed by the doctor who attended the birth. Even the document released was only a copy, and the version printed in the Los Angeles Times on June 16, 2008 is on a form only in use since late 2001. Even as it is, the document contains a warning that it is merely "prima facie"--threshold, rebuttable and thus inconclusive --evidence of birth, and the copy the Times printed mysteriously has the certificate number blacked out, thereby rendering the document unusable according to language on the bottom.

Given the seriousness of the offenses with which LTC Lakin is about to be charged, the American Patriot Foundation today renewed its plea for donations to its legal defense fund for LTC Lakin. Details are available at APF's website, http://www.safeguardourconstitution.com/.

I followed the link, and others from the site. Here is the link to a sworn affidavit from a minister stating that

(a) BO's grandmother told him twice that she witnessed his birth in Kenya;

(b) the Civil Registrar confirmed records of an Ann Dunham giving birth to a Barack Hussein Obama, III in Mombosa, Kenya. However, the file has been made classified.

Michelle Obama slips up and calls Kenya, Barack's home country in a video or maybe just an audio tape, I heard it. Barry Soetoro might be his real name.

John McCain was born outside the U.S, by the way. Remember that? The key is that he was born to a U.S. citizen, as was Obama.

On a more fundamental level, this isn't the role of the military. If you can't serve conscientiously, you resign or become a conscientious objector. The problem is, we don't allow CO status for politics.

Would the LTC feel the same way if Obama were a conservative? I doubt it. He is in the wrong line of work to refuse orders and he is way out of line doing this.

We can't let Obama politicize (as radicals do) every institution in America.

LTC Larkin knew it would go to a legal proceeding. You KNOW they will make an example of him and I wouldn't be surprised to see him sentenced for crimes, that are cherry picked by their wording, so that a birth certificate will not need to be produced and sworn to.

The larger issue is not merely the birth certificate, but ALL of the Obama documents which are sealed. WHO is our President? What is his history? And I don't merely mean the book he wrote where he regales the reader with his mentoring at the feet of notable communists. (Does it make me a racist when I ask those questions?)

I agree with LL that the secrecry and sealing of the Obama Admin invites questions on a number of fronts, but not whether he was lawfully elected president. Read the Erickson piece. So ... I guess there were fraudulent birth announcements put in the HI paper when B.O. was born to pave the way? If this is true, then he really is the messiah. He has his own prophecy/press corps.

What's next ... troops demanding to see an officer's commission before obeying orders? This is where such stuff goes. The military is no place for politics. If you don't like it, resign or move on. Every one understands when they sign up. (As for me, I waited until GHWB defeated Dukakis before I raised my right hand.)

What is a lawful order is covered, too. If it's not lawful, you disobey. If you are wrong, you pay the consequences.

DC... Civil disobedience must be both civil and disobedient. Lakin seems to me to have met those standards.

The restraints placed on the military are exactly the tools exploited by President Hussein. This protest is mild in comparison to one wherein troops turn guns onto their officers.

Will you be sporting the big foamy Uncle Sam chapeau at the Houston Tea Party? It would make it a lot easier to spot you in the newsreels.

Before people write off Lt Col Larkin as a nutcase "birther", I suggest they read up on the history of Col Billy Mitchell...

George, Billy M criticized the way missions were conducted, as arguably a professional miitary officer should do. Very different than challenging the authority of the chain-of-command. Obama's mom was a U.S. citizen. Enough said. Move on from this craziness.

Next point ... Nick, when you enter the military, you give up your right to engage in civil disobedience. That's why religious and many other rules are so different in the military. Sure, B.O. may exploit this, but the military will survive him and the next president, too.

DC Billy Mitchell was court martialed for insubordination for accusing the Army and Navy leaders at the time of an “almost treasonable administration of the nation’s defense.”

That is a little bit more than an intellectual critique of the way military missions are conducted!

The man was appointed an officer and a gentleman by the order of Congress. Once again Congress doesn't know what the devil it is doing. The man signed a paper just as I did and I did not refuse being sent to Vietnam. I didn't refuse when I was detailed to lead a platoon even when Army regulations distinctly did not permit me to do so. Your duty as assigned is your duty. So in the process we were sprayed with Agent Orange and now I am dying slowly but surely dying. Still duty takes precedence over personal whims.

I can't believe that Lt. Col. Lakin is facing court martial. He better have a good Los Angeles Bankruptcy Lawyer because things are going to get messy.
