Screw That Uterine Evacuation Horseshit - It's Murder

Here's your socialized medicine; a British hospital has been in violation of NHS procedures for years by failing to perform adequate testing of unborn babies. After a single ultrasound scan fails to detect a fetal heart beat, the nurses told expecting moms that their baby is stillborn and then schedule an abortion to remove the "dead" child. The government requires that three different types of scans be conducted before rendering this diagnosis. It is estimated that perhaps as many as 600 children  may have been wrongly diagnosed as still born for the past seven years.
[...]It was revealed that staff at the University Hospital of Wales in Cardiff were only using one type of pregnancy scan on expectant mothers, which can lead to false diagnoses of miscarriage.

The error, which breaches NHS guidelines, was only discovered after pregnant Emily Wheatley almost aborted her daughter on false medical advice.

Ms. Wheatley, 31, was told she had suffered a ’silent miscarriage’ and needed to deliver her dead baby, but found out that unborn Ella, now eight months old, was still alive when she had a second scan at another hospital.

Okay, hyperbole aside, it isn't murder, it's criminally negligent homicide. Under common and criminal law there must be one of three mens rea (Latin for guilty mind) mental states present for a defendant to be charged with a criminal act: they are - intentionally, recklessly and with criminal negligence. Simply put, Criminal Negligence comes into play when a reasonable person should be aware of a consequence but fails to act to avoid that consequence.

Simple examples of mens rea:
  • If you drive while drunk and kill someone, you ignored the consequences of your actions (drinking) which a reasonable person should have perceived and are charged with criminally negligent homicide. 
  • If you are sober and speeding and run a red light, killing a pedestrian, you are charged with manslaughter because you recklessly ignored the consequences of your action. 
  • If you hate an individual and run him over, killing him, you are charged with murder because you intended to kill him.

Adequate pre-natal testing was mandated by NHS regulations; in the hospital's failure to follow proscribed procedures to avoid certain consequences (the killing of healthy babies) they were negligent - these health care professionals should have perceived the risk - and caused the death of ... who knows how many children.

The estimated number of healthy babies (600) that may have been killed  is predicated on a possible error rate of 3% using the single ultrasound scan. This means that the number of botched procedures at this hospital was approximately 20,000 over a seven year period. That's almost 55 a week, 11 babies per day that these incompetent asses endangered.

And if NHS procedures were ignored for babies, what other procedures were thrown out the window? How many other people (adults, teens, small children) did this hospital actually kill? And was this purposefully done in order to meet budgetary considerations? What other hospitals are cutting corners in order to stay under budget?

A two month old article from the UK Telegraph:
The number of reported "never" events – which include operations on the wrong side of the body and medical instruments left inside the body after surgery, rose from 163 to 299 in just twelve months, the official statistics show.

From next month, NHS trusts will be ordered to publish quarterly lists detailing the number and type of all such errors, so that performance of different hospitals can be compared.

Doctors are instructed to record 25 types of incident which are so serious and avoidable that they should never occur.

Other blunders classed as "never events' include incorrect administration of insulin – which can kill – and misplaced feeding and breathing tubes, which mean a patient can drown on their own fluids.

The Department of Health said the figures had not doubled, because on top of the163 events reported centrally in 2011/12, further reports were made to other health authorities.

Federal Criminal Is Overruled

Idiot federal judge who tossed the NYPD's stop and frisk program is actually not an idiot. She's a criminal. By her own words she knowingly violated federal regulations.
... District Judge ran afoul of the Code of Conduct for United States Judges, Canon 2 ('A judge should avoid impropriety and the appearance of impropriety in all activities.')"

Specifically, the court said Judge Scheindlin had "compromised" the appearance of partiality by improperly inviting a stop-and-frisk suit. In a December 21, 2007 hearing on an earlier case, Judge Scheindlin stated: "[I]f you got proof of inappropriate racial profiling in a good constitutional case, why don't you bring a lawsuit? You can certainly mark it as related."

She also stated that, "[W]hat I am trying to say, I am sure I am going to get in trouble for saying it [emphasis mine~ sig94], for $65 you can bring that lawsuit." And she concluded by noting, "And as I said before, I would accept it as a related case, which the plaintiff has the power to designate."

That point about a "related" case is crucial because it allowed Judge Scheindlin to grab the stop-and-frisk case for herself, rather than follow the district court's established practice of assigning cases randomly to judges. As the Second Circuit noted on Thursday, two of the attorney groups working on that earlier case helped another defendant file the stop-and-frisk case that Judge Scheindlin accepted as "related" and which she used to find stop-and-frisk illegal.

This is all a remarkable abuse of court practice, and it suggests bias against the NYPD. The Second Circuit also rebuked Judge Scheindlin for "a series of media interviews and public statements purporting to respond publicly to criticism of the District Court." These also revealed her predisposition to rule against the police.

The bombshell means that the case is remanded to another district court judge, who will implement the stay until the appeals court rules on the merits next year. Given Judge Scheindlin's dubious ruling, we'd expect a reversal on the law. By the way, the Second Circuit panel includes Bill Clinton appointees Jose Cabranes and Barrington Parker, as well as John Walker, a George H.W. Bush appointee. Judge Cabranes is one of the most widely respected on the appellate bench.
I'd say write your congressional representative to demand her impeachment but Congress is useless as hell also.

CANON 2: A JUDGE SHOULD AVOID IMPROPRIETY AND THE APPEARANCE OF IMPROPRIETY IN ALL ACTIVITIES

(A) Respect for Law. A judge should respect and comply with the law and should act at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary.
(B) Outside Influence. A judge should not allow family, social, political, financial, or other relationships to influence judicial conduct or judgment. A judge should neither lend the prestige of the judicial office to advance the private interests of the judge or others nor convey or permit others to convey the impression that they are in a special position to influence the judge. A judge should not testify voluntarily as a character witness.
(C) Nondiscriminatory Membership. A judge should not hold membership in any organization that practices invidious discrimination on the basis of race, sex, religion, or national origin.


COMMENTARY

Canon 2A. An appearance of impropriety occurs when reasonable minds, with knowledge of all the relevant circumstances disclosed by a reasonable inquiry, would conclude that the judge’s honesty, integrity, impartiality, temperament, or fitness to serve as a judge is impaired. Public confidence in the judiciary is eroded by irresponsible or improper conduct by judges. A judge must avoid all impropriety and appearance of impropriety. This prohibition applies to both professional and personal conduct. A judge must expect to be the subject of constant public scrutiny and accept freely and willingly restrictions that might be viewed as burdensome by the ordinary citizen. Because it is not practicable to list all prohibited acts, the prohibition is necessarily cast in general terms that extend to conduct by judges that is harmful although not specifically mentioned in the Code. Actual improprieties under this standard include violations of law, court rules, or other specific provisions of this Code.

But there may be a way to remove a federal judge other than impeachment.
Most everyone assumes that impeachment is the only means of removing federal judges and that the Constitution's grant of good-behavior tenure is an implicit reference to impeachment. This Article challenges that conventional wisdom. Using evidence from England, the colonies, and the revolutionary state constitutions, the Article demonstrates that at the Founding, good-behavior tenure and impeachment had only the most tenuous of relationships. Good-behavior tenure was forfeitable upon a judicial finding of misbehavior. There would have to be a trial, the hearing of witnesses, and the introduction of evidence, with misbehavior proved by the party seeking to oust the tenured individual.

Man's View Of A God-Sized Universe


Over to Kid's site there is a video that shows how are tax dollars are are spent in a way that actually produces something, knowledge of the Universe - God's Creation. This is the Hubble Telescope view of the Ultra Deep Field, a section of sky the size of a grain of sand that to the naked eye has nothing in it, but actually contains over 10,000 galaxies, each galaxy containing over 100 billion stars.



Now within that video (at approx. the 2:25 mark) there is a link to another video that explains how it is possible that some galaxies are moving away from us faster than the speed of light. That video is here.




There are three different measurements in the red shift of light emitted by moving galaxies:
  • Doppler Redshift results from the relative motion of the light emitting object and the observer. If the source of light is moving away from you then the wavelength of the light is stretched out, i.e., the light is shifted towards the red. These effects, individually called the blueshift, and the redshift are together known as doppler shifts.
  • Cosmological Redshift: a redshift caused by the expansion of space. The wavelength of light increases as it traverses the expanding universe between its point of emission and its point of detection by the same amount that space has expanded during the crossing time.
  • Gravitational Redshift: a shift in the frequency of a photon to lower energy as it climbs out of a gravitational field. (cosmological, gravitational and dopplar)
Scientists estimate that the Universe is 13 to 14 billion years old, that is, since the Big Bang began everything and which is also responsible for the cosmological red shift.

At the same time, scientists tell us that the size of the observable universe - that part of the Universe that our most powerful instruments can measure - is about 45 billion light years.

The Big Bang Theory speculates that the space/time continuum started as an Initial Singularity, a single point of zero volume but containing incredible mass, that started to expand. If so, the expansion of the universe has to be at a rate at least three times the speed of light to account for the current observable Universe. And this expansion rate is increasing...
74.3 plus or minus 2.1 kilometers (46.2 plus or minus 1.3 miles) per second per megaparsec (a megaparsec is roughly 3 million light-years).
And why is the Universe expanding at an accelerated rate? Because of something called "dark energy."

And what is dark energy? It is something invented by humans who must name things they do not understand. But this is not a bad thing! To paraphrase Dean Wormer, "Fearful, ignorant and superstitious is no way to go through life, son."

Ever so slowly and at great cost do we pry apart God's Creation. As the Ultra Deep Astrological Field shows us, there is a lot more out there than we can imagine.

Piece by piece, we pick at a puzzle created by a God of infinite intelligence and infinite ability. As Isaiah 55:8-9 tells us

It's The Crime, Stupid

Another liberal nonsense (no sense at all) study on how black neighborhoods are denied healthy choices because grocery store owners are all racist bastards and want black people to die from overdosing on Cheetos bought at the corner convenience store.

Poor, mostly black neighborhoods face double jeopardy when it comes to supermarket access, according to a study recently published by the journal Preventive Medicine.

That may not sound like news at all: Scholars and activists have long fretted that poor, minority neighborhoods have worse access to supermarkets, which is tied to less healthy diets.

But researchers from Johns Hopkins University wanted to see how different neighborhood traits -- poverty and racial makeup -- were related to the problem. For instance, what did it mean to be in a poorer white neighborhood, versus a wealthier black neighborhood?

[...]But they also had fewer supermarkets than poor white neighborhoods, suggesting that race still played a role apart from poverty. In fact, the study showed that black neighborhoods with little poverty had fewer supermarkets, on average, than high-poverty white areas.

"Our study found that it's not simply an issue of poverty," wrote Kelly Bower, an instructor at the Johns Hopkins School of Nursing, in an email to the Los Angeles Times. "In fact, a racially segregated poor black neighborhood is at an additional disadvantage simply because it is predominantly black."
Idiots. Money is green. That's the only color that matters to merchants. Something else drove them out of the ghetto. Gee, I wonder what it is?

Just The Right Man For Administering ObamaCare

This will be a high stress job and there are few people who can take the strain of such a position. That's why Hajj Abd Al-Nabi is Obama's go to guy for ObamaCare.
In a revealing interview, Egypt’s chief executioner spoke of his childhood past-time that led to his career taking the lives of those sentenced to death in the Muslim-majority country. Hajj Abd Al-Nabi, who serves as the chief warrant officer in the Egyptian prison system, claims that he has executed approximately 800 persons during his days as chief executioner. Speaking on television, Al-Nabi said “I have placed [the noose] around some 800 heads – tough people, big people, young people … All the despicable crimes—killing, adultery, premeditated murder, and so on.”

Al-Nabi has the experience, the will, the aptitude and most important, the lack of compassion required to get the job done.
Al-Nabi said that as a child he was accustomed to strangling cats and dogs. “When I was young, about 13 or 14 years old, … my hobby was to watch a cat, to place a rope around its neck, place a rope around its neck, strangle it, and throw it into the water,” Al-Nabi said. “I would get a hold of an animal—even dogs. I would strangle these animals and throw them into the water, even dogs.”

“Strangulation was my hobby,” said Al-Nabi smiling.
And now he may have a new hobby - denying health care benefits.

It's far easier than finger painting and the sound of a terrified, howling 72 year old retiree who is going to lose both his legs is immensely more satisfying than hearing a kitty get snuffed.
His parents told him he would go to “hell” for killing animals, but he persevered in his hobby. “It’s a gift,” he explained. “I was a little Satan.” Once he was hired as Egypt’s chief executioner, Al-Nabi told himself “Congratulations, now grow a mustache.”
And what a beauty it is! Al-Nabi has strangled a half dozen cats, dogs and a ferret with his mustache.

Waco, How About Visiting Waco?

Amid a furious global controversy over the National Security Agency's spying on U.S. allies, Federal Bureau of Investigation Director James Comey said on Monday he will order all new FBI agents to visit the Rev. Martin Luther King Jr. Memorial to reflect on past “abuse and overreach” by the agency.

Comey noted that former FBI Director Louis Freeh had ordered all new agent classes to visit the Holocaust Museum “so they could see and feel and hear in a palpable way the consequences of abuse of power on a massive, almost unimaginable scale.”

That will continue, Comey said.

But “I'm going to direct that all new agents and analysts also visit the Martin Luther King Memorial here in Washington,” the FBI director announced, with President Barack Obama looking on. “It will serve as a different kind of lesson, one more personal to the bureau, of the dangers in becoming untethered to oversight and accountability.”

The FBI spied on King, the famed civil rights leader, throughout the 1960s until his assassination in 1968. 
How about a trip to Waco to reflect on government"overreach"?

I'll never forget walking into the PD locker room in April of 1994 and right above the shoe shine machine there was a poster advertising a picnic sponsored by our local ATF office. The picnic advertisement sounded like a celebration - all area law enforcement were invited to attend the ATF's "Waco BBQ." While shining my shoes I read it several times and I was bothered by the callousness of this.

Sure, you have to have a thick skin in our profession; but this was a bit off the map, even for cops.

I didn't go, I don't think many did.

Old School Cops

I just received notification that one of our few remaining retired cops that served in WWII has passed away.
Henry Joseph Zajac, 91, of Liverpool passed away peacefully on Thursday. Born in Syracuse he was a graduate of Vocational High School and a WWII Navy Veteran serving in the South Pacific.
Another retiree recollected one of Hank's comments when he arrested a mouthy Asian defendant:
"Shut up! I shot your father out of a tree on Guadalcanal and I'll do the same to you!"
There's no school like the old school.

NYC Subways - Not So Fresh



I can sympathize with NYPD cops. When the judges and politicians get on your ass, back off and CYA. Nothing on your pay stub says you must get sued to cash a check. The NYPD is reacting to the decision of the lame federal judge who severely restricted their stop and frisk operations. If the cops violate that order, they can be arrested and sued civilly in federal court.

It’s an express train — to the bad old days.

Cops are giving homeless people and panhandlers in the subways the kid-glove treatment, arresting subterranean scofflaws far less frequently than just two years ago, data show.

The ranks of the homeless, meanwhile, have swelled to 1,841 this year — a 13 percent increase over last year’s tally, the city’s Department of Homeless Services says.

For straphangers, it has created an atmosphere of fear.

“I feel threatened, especially taking the train at night,” explained Brooklynite Lortashia Smith, who said she has been followed off trains several times. “The police can definitely do more.”
Now this instance is an enforcement activity that is definitely affected by that loon judge. Someone is following you? A cop would do a stop and frisk.
The NYPD said panhandler/peddler arrests in the subway have increased over the past year, with 409 pinched so far in 2013 versus 395 in 2012. But those numbers pale in comparison to 2011, when it was reported that in a six-month span that year, a whopping 930 panhandlers and peddlers — the two are not separated in the data — were arrested.

“There’s been a drop-off,” acknowledged one police source.
The stop and frisk ruling is perhaps tangential to the panhandling enforcement, but it is a similar activity where the officer has to confront someone. These two issues may or may not be related, but there is little doubt in my mind that they are.
Even panhandlers are scared.

“There’s more people down here,” noted Sarah Colon, who said she has been homeless ever since Hurricane Sandy. “The city’s not doing what it’s supposed to be doing. They need to make the shelters better than what they are now.”

Things could get a lot worse.

“I believe this can turn into ‘Mad Max’ down here,” said Maurice Solomon of The Bronx. “It’s a safe haven — it’s warm for them, and people give them food.”

You also have to take into consideration the relaxation of mental health laws back in the seventies when mentally/emotionally disturbed persons (EDP) were mainstreamed back into society. It is estimated that EDP's kill perhaps a thousand or more people a year.
When looking at the rates of violent crime overall — homicide, for instance — the best estimate is that 5% to 10% of murders are committed by people with mental illness. But a far larger proportion of mass homicides, including the brutal July 2011 attacks in Norway, the Tucson, Ariz., shooting that wounded Congresswoman Gabby Giffords and the Virginia Tech massacre in 2007, involve perpetrators with mental illness. The proportion far outstrips the rates of mental illness in the population.

Last year over 24,000 people were murdered in the US. The 5-10% range specified in the article above indicates that from 1,200 to 2,400 of these victims were killed by EDP's.

Unfortunately the only way to check the veracity of this is to see what happens to the homicide rate in NYC over the next few years. It may be a good idea to stop taking the subway.
