Anniversary of an Abomination: 1/22/73

Whatever your views are on abortion, Roe v. Wade was and is a constititutional abomination. Not one of my liberal professors in law school would defend it on the merits. Oh, but they liked the result ... and that's what really counts to them. Some even admitted it.

You can trace a lot of America's national political dysfunction to the force-feeding of abortion into the national political discourse. The founders intended no such thing. Thus, the Roe Court had to find its way in the shade (or was it the shadows?) of the "penumbra".

Because of Roe, every national election now has to factor in the pro life vs. pro-choice vote. It's a shame. I am pro-life, but I firmly believe that each state should be allowed to find its own way on this. Can you imagine how conservatives would own the political landscape in this center-right country without the most contentious moral/political issue of our day in each election? It would be fabulous.

And if California were to see it different than Texas, so be it. A lot of states would restrict or even prohibit abortions. Others wouldn't. That's the beauty of our federal system. It allows for local control where a constitutional right is not implicated. As a result of allowing our system to work, we would have a real-life study in which way works best ... in protecting women, preventing abortions, and taking care of children. In such a system where local control is paramount, liberty thrives and the nation finds out what works in a way that respects the rights of citizens to make important decisions impacting their lives.

So, whenever you hear some one talking about Roe "legalizing" abortion, please correct them. This is not what the decision did. Rather, the decision took away the power of states to legislate meaningfully -- to perhaps restrict, maybe not -- on the subject of abortion. Some states would legalize abortion, and others would not. Roe fundamentally limits debate, and ultimately freedom.

Abortion is a tough issue that touches many of us at the core level. But the hard left knows it can't win this debate on the merits. So, it backs unprincipled actions like Roe that take the debate off the table.

But the spirit of liberty, the pursuit of happiness ... and life ... that still flows through the veins of Americans will keep coming, fighting, and pressing on, until our Declaration of Independence is once again honored in the nation's highest court.

The issue of state's rights really reigns supreme. The War of Northern Aggression/Civil War was fought over that very principle even though revisionists often choose to paint it as a slavery issue.

It clearly touches Roe v Wade and so many other matters including control of bodies of water, and the actual definition of "interstate commerce".

There is no greater concern for me during the next three years than the composition of the Supreme Court.

I remember this time, the hue and cry over the thousands of woman who were dying every year from "back alley" abortions. Later, looking it up from CDC sources, turns out it was only about 20-30 deaths year. The narrator of the "Silent Scream," Dr. Bernard Nathanson, details some of the lies perpetrated by murderous feminists who want to destroy a living creature who, at 11 weeks after conception:

The heart is beating (since 18-25 days);
Brain waves have been recorded at 40 days;
The baby squints, swallows, and can make a fist;
The baby has fingerprints and can kick;
The baby is sensitive to heat, touch, light and noise;
The baby sucks his or her thumb;
All body systems are working;
The baby weighs about 1 ounce and is 2 1/2 to 3 inches long;
The baby could fit comfortably in the palm of your hand.

This describes a baby less than 3 months old - 6 months prior to birth.

Dr. Nathanson is a former abortion doctor who, by his own word, killed 75,000 children. He was one of the founders of NARAL and describes the tactics they used to realign public opinion on abortion.

Capture the media.
Vilify the Catholic Church
Suppression/ridicule all evidence supports the precept that life begins at birth.

If you examine it, the concepts are very similar to the global warming movement.

I have discovered through discussions with a liberal family member that unconstitutional actions and court decision do not bother him in the least if the outcome is one he favors. This person just laughs and basks in what he sees as a victory. He doesn’t see the net loss – our freedoms, the damage decisions such as the one discussed in this post do to our society, and the damage done to our Constitution.

LL, Imagine how the MSM would react were the theme of the Tea Parties to become States Rights.

sig94... you can't expect the Left to give up a method that seems so powerful when presented to a dumbed-down populace.

Arby... To the Left, anything that stands in the way of their "feel good" philosophy is a denial of their freedom.

Nickie,

I re-posted this at Conservative Firestorm. Thank you for writing it.

...This is priority number one. All other freedom gains will come from restoring the 10th amendment to it's rightful place in the national discourse.

Donald, this was actually written by my estranged nephew, DC. He was always the one to stir up controversy.

Toasty... I agree, but it should be done after regaining power. For the Tea Parties to focus on that instead of taxation and jobs, would be political suicide.

I could be wrong.

I should have said that was job number one at the state level. It will help the states say NO to the Feds when they want more taxes to provide "services" the states do not want.

Personally, I feel the Fedgov has no place promoting "job creation". It is code speech for throwing tax dollars at persons/ companies that take the cash and then offshore the jobs.

The tea party types next target; state and local government. Until we get all the civil "servants" ducks in a 'Roe' so to speak, from governor to dog catcher, will will never get things straightened out.

My apology to DC. I did not mean to hijack the Roe vs. Wade thread to 10th amendment issues. I agree that this is an issue best left to the states...

We agree, Toasty.

And don't worry about DC. It's Friday. By now he's probably line-dancing down at the Saddle Sore Club.

Toast, Nick is right (for once). No problema.
